Employees who meet the qualifying conditions are protected, by the Unfair Dismissals Acts 1997-2015, from being unfairly dismissed.
Employers must be cautious, when dismissing an employee, that there is a potentially fair reason for dismissal. Equally as important is the need to operate a fair procedure - faulty procedural steps, even when there is a good reason for dismissal, may render a dismissal unfair.
Dismissals for certain reasons will be unfair regardless of the procedure undertaken, for example if the dismissal is discriminatory or if the dismissal is connected with an employee taking parental leave.
An employee has various options for redress under the Act, including financial compensation.
