Fixed-term employees
Under the Protection of Employees (Fixed-Term Work) Act, 2003, employers must provide fixed term employees with the same terms and conditions of employment as comparable permanent employees, unless there are objective grounds justifying less favourable treatment.
The Act also states that where a fixed-term employee is treated less favourably than a comparable permanent employee as regards a term or condition of employment, the treatment shall be considered to be justified on objective grounds, if the terms of the contract as a whole are at least as favourable as the terms of a comparable permanent employee’s contract of employment.
