Adoptive leave


The purpose of the Adoptive Leave Acts, 1995-2005 is to provide protective leave from employment for adopting mothers and, in some instances, adopting fathers. While on leave, these employees are protected from unfair dismissal. The Act covers all female employees and, in some instances, male employees.

Adoptive leave is an entitlement available to all female employees who are adopting a child, or to sole male adopters. An adopting employee is also entitled to paid time off to attend any pre-adoption classes and meetings within the State, which the employee is obliged to attend.

Employers are under no obligation to pay employees on adoptive leave, though a state benefit may be available to some employees.
